A Prenuptial Agreement - Should You Have One?

By Carl DiNello By now, we have all heard the sad statistical fact that roughly half of all marriages performed will end in divorce. This uncomfortable reality has resulted in many couples considering the legal option of a prenuptial agreement prior to them saying “I do”. Commonly referred to as a “prenup,” a prenuptial agreement is a legal contract entered into by the prospective bride and groom prior to their marriage. This agreement will include specific provisions in regard to the division of property, and spousal support should the couple divorce. When would you need a prenuptial agreement? You may consider the protection of a prenuptial agreement should any of the following circumstances exist: * When one party is considerably wealthier than the other. * When one party already owns a home, or possesses other significant assets. * When one party is a part, or full owner of a business. While there are other reasons, these are probably the most common situations where a prenup may be a good idea. Should your situation be such that a prenup may be in your best interest, bring it up early in your wedding discussions. Don’t wait until the last minute to spring it on your significant other. Make sure you are open and honest about your reasons for discussing a prenuptial agreement. Also, try to agree on the basic framework of the agreement before bringing it to the lawyers. Draw up a detailed and complete list of all assets, and how they should be divided in the event of a divorce. When both of you are in agreement regarding the prenup, it is time for each of you to get your own lawyer. Should you both use the same attorney it is quite possible that a judge may declare your prenuptial agreement unenforceable on the basis that either spouse may not have received adequate legal representation. You both must be sure that you have fully disclosed all of your assets. Any attempt to mislead or deceive will result in your agreement being thrown out by the court. Also, keep in mind that another way to have the judge throw out your agreement is to make it too one sided. A valid prenuptial agreement must be fair and equitable to both parties. It must not leave either party destitute. Here are a few more things to keep in mind regarding the creation of a prenuptial agreement: A prenuptial agreement does not pertain to child support. What this means is that you can not waive your obligation to provide child support, nor can you designate a lesser amount of child support than what would be provided to the child by the courts. A will does not supersede a prenuptial agreement should the terms of the prenup be more generous. In other words, you can not use a will to leave behind a lesser amount of money than is stipulated in your prenuptial agreement. However, you can leave more money in the will than the prenup stipulates. A clause may be included in the prenup that will allow the agreement to expire after a specified period of time. This clause is referred to as a “Sunset Provision,” and in many states cause a prenup to automatically lapse after a specified number of years unless both parties choose to renew the terms. In some states, a prenuptial agreement will automatically lapse upon the birth of a child. I see sooooo many people jump from opportunity to opportunity like their life depended on it. STOP DOING THAT! By refusing to stay focused on ONE opportunity for an extended period of time, you are setting yourself up for failure. Think of it kind of like being a hunter. Lets assume you are hunting deer and you’ve got your trusty rifle. You see a deer on your left, one on your right, and one in front of you. Now here’s my question to you… Can you shoot all 3 at the same time? Of course you cant…you have to take them 1 at a time. And the same goes for your success in Multi-Level-Marketing I think that part of the problem comes because people misunderstand this idea of “multiple streams of income” Achieving multiple streams of income is great, but you dont achieve it by jumping in 3 programs at the same time If you want multiple sources of income then start with ONE. And then once that ONE is making you money on a residual basis then you can take some of your earnings and invest it into another stream of income. I find it strange that some people who collect coins, paper money, or stamps, always want some kind of return on their investment. These are the same people who think nothing of buying a new car and then selling it a few years later for a fraction of what they paid for it. A new car loses value as soon as you drive it on the road! As for investing in paper money, if someone is buying notes and thinking how much will they be able to get when they sell them again, this person has the wrong hobby. Enjoy collecting for the pleasure and for the fun of it. Coins and stamps are tangible reminders of years gone by. Yet, while coin collecting is flourishing as a hobby, stamp collecting is decreasing in popularity. Many families who inherit stamp collections are more interested in getting the collection appraised than continuing the collection. You cant collect something if you dont know what it is. Stamp collecting dates back to 1840, when the first stamp was issued in England. Added to this is the excitement of searching for and finding specific coins and the challenge of identifying new ones. Why is coin collecting thriving and stamp collecting dying? Coins are still being used and are still fascinating. It is an investment as well as a hobby. Coins continue to go up in value while many stamps are at the peak value they will ever receive. Furthermore, many are going down in value. Enjoy your hobby, and consider whatever you invest in it to be pleasure money, the same way you would count money you spent going to ball games, or dining out, or buying new clothes.
